AED Legislation in Ontario

Chase McEachern Act (2007) – Heart Defibrillator Civil Liability Act
This law offers legal protection to individuals who, in good faith, use or make available an AED during an emergency—shielding them from civil liability unless gross negligence is proven. It’s Ontario’s version of a "Good Samaritan" law regarding AED use.

Portable Heart Defibrillator Act (2000)
This early legislation required AEDs to be installed and made accessible in significant public buildings—including arenas, stadiums, shopping centres, and both public and Crown-owned facilities. It also mandated development of guidelines for use and maintenance by the Ministry of Health and Long-Term Care.

Defibrillator Registry Act, 2019 (Bill 140)
Although passed, this Act is not yet in force. It mandates:
- provincial registry for publicly accessible AEDs
- Registration within 30 days of installation
- Notifications to the registry when units are moved or removed
- Registry access for 9-1-1 dispatchers to guide callers to nearby AEDs
- Maintenance and testing record requirements

Defibrillator Registration and Public Access Act, 2020 (Bill 141)
An evolution of previous legislation, this Act—now enacted as of 2020—reinforces:
- designated premises to install, maintain, signpost, and allow access to AEDs
- AED registration within 30 days post-installation
- Obligations to notify authorities if units are relocated or removed
- Enforcement provisions, including fines for non-compliance and duties for training designated actors.

Proposed Amendments for Construction Sites (2025)
As of May 2025, Ontario is moving to make AEDs mandatory on construction sites that:
- Operate for three months or longer, and
- Employ 20 or more workers at the same time.
These proposals are part of the "Working for Workers" legislative package. To support implementation, the Workplace Safety and Insurance Board (WSIB) is expected to offer cost reimbursement
